1. Acceptance of terms

These Terms of Service govern your access to datacontrolgrid.click and use of the Data Control Grid application. By accessing the website or using the software, you agree to these Terms. If you do not agree, do not use the website or application.

You must be legally capable of entering into these Terms in your jurisdiction. If you use Data Control Grid for an organization, you represent that you have authority to bind that organization.

2. Description of the software

Data Control Grid is a local data tracking utility and analytical application for organizing portfolio change journals, contextual notes, historical entries, and related user-supplied records. Its purpose is informational organization and personal record-keeping.

Compatibility references to Binance identify the type of information users may organize. Data Control Grid is not a Binance product and is not affiliated with, endorsed by, sponsored by, or certified by Binance Holdings Ltd.

3. Permitted use

Subject to these Terms, you may use the website for information and use the application to organize and review records that you are entitled to use. You are responsible for the accuracy, legality, and suitability of information you enter and for maintaining appropriate local backups.

Your use must comply with applicable laws, third-party rights, and any additional terms presented through the distribution platform.

4. Prohibited use

You may not:

• Use Data Control Grid for unlawful, fraudulent, deceptive, or abusive activity
• Attempt to disrupt, overload, bypass, or compromise the website or software
• Introduce malware or use automated methods that interfere with normal operation
• Infringe intellectual property, privacy, confidentiality, or other rights
• Misrepresent Data Control Grid as an exchange, broker, wallet, custodian, or financial service
• Remove legal notices or imply an unauthorized relationship with Data Control Grid, Binance, or Microsoft
• Reverse engineer the software except where applicable law expressly allows it

5. Intellectual property

The website, software, original design, text, and associated materials are owned by or licensed to Data Control Grid and are protected by applicable intellectual property laws. These Terms provide a limited right to use the service; they do not transfer ownership.

You retain rights in records and notes you create. You grant only the rights technically necessary to process those records locally at your direction.

Third-party names and marks belong to their respective owners. Binance® is a trademark of Binance Holdings Limited. Microsoft and Microsoft Store names are the property of their respective owners. Reference to a third party does not imply affiliation or endorsement.

6. Software limitations and user responsibility

Data Control Grid depends on user-supplied information and may contain errors, omissions, delays, or incompatibilities. You must independently verify important records. Summaries and comparisons may not reflect current market information and should not be treated as authoritative.

You are responsible for device security, access controls, software updates, and backups. Removal, device failure, or changes to local storage may result in loss of records.

7. No financial institution status

Data Control Grid is not a bank, financial institution, cryptocurrency exchange, broker, investment platform, payment provider, or regulated financial service. Use of the software does not create an advisory, fiduciary, brokerage, or custodial relationship.

8. No wallet, custody, or transaction functionality

The application does not provide a wallet, connect wallets, access private keys or seed phrases, hold or custody assets, process funds, or execute purchases, sales, transfers, deposits, withdrawals, or other transactions.

Never provide private keys, seed phrases, wallet passwords, or transaction credentials to Data Control Grid.

9. No financial or investment advice

All records, summaries, comparisons, text, and other outputs are provided solely for informational and record-keeping purposes. Nothing on the website or in the application is financial, investment, tax, accounting, or legal advice, or a recommendation to acquire, sell, or hold any asset.

You remain solely responsible for decisions you make. Seek advice from appropriately qualified professionals where necessary.

10. Third-party services

The website may link to the Microsoft Store homepage or other external services. Third-party products and services are governed by their own terms and policies. We do not control and are not responsible for their content, availability, conduct, or data handling.

A link or compatibility statement does not represent sponsorship, certification, verification, partnership, or endorsement by Microsoft, Binance, or another third party.

11. Disclaimer of warranties

To the maximum extent permitted by law, the website and software are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, and security.

We do not warrant that the software will be uninterrupted, error-free, compatible with every device or data format, or that local records will never be lost. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, Data Control Grid and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, records, opportunity, revenue, or profits; or decisions made using the software, even if advised that such loss was possible.

Where liability cannot lawfully be excluded, it will be limited to the minimum amount permitted by applicable law. Nothing in these Terms excludes liability that cannot legally be limited or excluded.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold Data Control Grid harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use, your violation of these Terms, or your infringement of another person’s rights.

14. Changes, suspension, and availability

We may modify, update, suspend, or discontinue all or part of the website or software. Features and compatibility may change over time. We are not obligated to preserve a particular function or maintain access indefinitely.

15. Changes to these Terms

We may revise these Terms to reflect changes in the product, law, or operating practices. Revised Terms will be posted here with a new effective date. Continued use after revised Terms take effect constitutes acceptance where permitted by law.

16. Governing law and disputes

These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles. Courts with competent jurisdiction in Thailand will have jurisdiction over disputes, except where mandatory consumer law requires another forum or process.

Before filing a formal claim, you are encouraged to contact us and attempt to resolve the concern informally.

17. Severability and entire agreement

If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect. These Terms and referenced policies constitute the agreement concerning use of Data Control Grid.
